This website is operated by Bam Luxury Store - Margot Louro. Throughout the site, the terms “we”, “us” and “our” refer to Bam Luxury Store. Bam Luxury Store offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

You do not have the right to copy any content (including images) on this website without our consent. We are owner of the content on this website.

 

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

If we can't accept your order we will inform you as soon as possible by email or phone. You won't be charged. This might be because the product is out of stock, because we identify an error on the price or on the description of the item, because you did not met the financial condition requirement or your payment is not safe, you have failed providing the documentation requested to verify your identity.

 

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. You need to make sure all the information and details you provide on registration and at any time are correct and complete. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you the best way. We reserve the right to suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions. You can cancel your registration at any time by informing us in writing at contact@bamluxurystore.com. If you do so, you must immediately stop using the Website. 

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES

(if applicable) Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.Concerning payments, once started it needs to be paid fully, down payments are non refundable.

To complete a sale of your Product to or through Bam Luxury Store or to complete any other transaction withus, you must: (1) Order an item; (2) Provide true, up to date and accurate account information about yourself and any Product you submit to us; (3) Comply with all terms and conditions of this Agreement; (4) Comply with all applicable laws and regulations, including all import and export laws; and (5) Have the legal capacity to enter into agreements and to convey title and interest in any Product that you submit to us. In order to receive payments for any Products we purchase from you, you must provide us with information including a valid email address at which you are able to receive email, a valid postal address at which you are able to receive mail, and your first and last name. Bam Luxury Store shall not be responsible for communication errors should your contact information be inaccurate or incomplete. You are responsible for ensuring that you can receive emails from us, and we are not responsible for any emails that were not received by you because they were blocked or filtered as spam. You understand and agree that if you fail to provide us with accurate and up to date information about yourself: (a) we will not be responsible for any misapplied payments or payments sent to a wrong address, and (b) any unclaimed funds may be subject to collection by governmental authorities under applicable unclaimed funds and escheat laws. You agree that we have no obligation to you if any of your unclaimed funds are turned over to governmental authorities. 

Any item you want to sell and we received with a condition that has been misportrayed will only be returned to you against a 60€ fee or a modified quote. If you do not pay the return fee, the Product will remain the property of Bam Luxury Store. These return assurance fees will be netted from any payment due by Bam Luxury Store to the seller.

All quotes provided are subject to an inspection and these can be modified, amended or revoked. We will not honour an incorrect quotation. You will need to send the item to us for authentification and final offer. You will need to send us your passeport. If everything is in order we will proceed to put the item online (once sold you will receive the payment 10 days after the client received it), or we will proceed to your payment if we buy the item from you within 10 days. It can take up 2 working days to be received depending on your bank.

If we notice the item(s) are spurious, stolen or not your property we will withdraw the quotation/offer. If you have already received the funds you will be notified and must pay back the monies in full. And if we have the item it will be return at your cost or destroyed.

You must have all right, title, and interest in any and all Products that you are looking to sell to us. The Products and the sale and shipment of such items to us: (a) must comply with all applicable laws, statutes, ordinances, including without limitation all import and export laws, (b) may not infringe on third party intellectual property rights (including copyrights, trademarks, patents, trade secrets or other proprietary rights), and (c) shall not be counterfeit, stolen, or fraudulent. You represent and warrant that the Products are free of any liens or encumbrances. By using the Bam Luxury Store’s services, you agree to indemnify us from all claims or losses sustained by Bam Luxury Store as a result of any breach of these representations and warranties.

You, the customer, remain responsible for the risk-of-loss for the Products until they are delivered to us. You are responsible for any damages that may occur to your Product while in transit to us. Bam Luxury Store is responsible for risk-of-loss when it opens the package containing your item(s) and ceases in the event that your product is returned to you for any reason. Furthermore, the risk-of-loss will be transferred to you once we delivers the package to the carrier to be returned to you and you will bear the risk-of-loss while the Product is in transit.

You agree to comply fully with all of the import and export laws, regulations, rules and orders of the United States, or any foreign government agency or authority, and that you will not directly or indirectly transfer your Product without proper authorization from the Spanich/Europe and/or foreign government. You bear responsibility for and assume all expenses relating to your compliance with the described laws, regulations, rules and orders, and for obtaining all necessary authorizations and clearances in order to convey your Product to Bam Luxury Store, including without limitation, valuation, classification and duties applicable with the import of any and all goods. We are not liable for any charges, and these are to be borne by you, we do not have control over these. 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us or an item you want to sell. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Cancelation requests by customers can only be made within one hour of the order being placed. All such notices need to be in writing by email. Beyond that all orders are final. Bam Luxury Store reserves the right to cancel any order at any time, before or after payment is processed, for security, fraud review or any other reason.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

If you wish do change any information after ordering you can write to us by email : contact@bamluxurystore.com but if the item has already been shipped it won't be possible to make any change.

RETURNS 

All Sales are final. This policy is offered in addition to your legal rights.

Purchases made online can be exchanged or refunded within 14 days of purchase should they not be as described, defective or it fails to preform as described.

The item(s) must be received back in the same condition it was received in.
All tags and labels must be intact, and the item should not show signs of wear/additional wear. Should the returns label be removed this will void the refund policy.

We do not cover the cost of your return (including taxes and import duties), so please make sure you send the item back using a tracked and insured service with adequate packaging for transit. If the package is lost Bam Luxury Store can't be responsible and will not give you the refund.

You may return your item to our Spanish address, please send us an email before sending it back. Returns can take up to 7 working days to process from when we receive them as they go through our authentication process. We will pay the return only if the product is faulty and not as described.

Refunds are NOT offered on any Hermès and Chanel items including bags, accessories, shoes, homeware, and fine jewellery. We do not offer refunds on jewellery for pierced ears. 

CURRENCY

Items sold to customer outside Europe/Euro will clear bank accounts at the prevailing exchange rate at the time purchased. Prices other than EURO mentioned on our shows are estimates indicative of the charge you will see for the payment in your home currency, but are not guaranteed.

Please understand that fluctuations in exchange rates are beyond Bam Luxury Store’s control. You also may incur international transaction fees from your bank or credit card provider which are out of our control. However, we always offer our customers benefits where we can and often cover customs charges for orders placed on our live shows (provided the host has specified this benefit available in the show).

In this regard, we cannot be held responsible for any foreign exchange losses occurring if you decide to return an item to us. Our non-EU customers accept this risk when they purchase from us as a EU based company.

DELIVERY

We cannot be held responsible if an item is longer to arrived than expected. The item will be delivered to you and only you. If you are not home for delivery, you will be contacted by our logistic partner to rearrange delivery or how to collect the item from a local depot. We cannot be held responsible if you are not home during the delivery. If the package is returned to Bam Luxury Store because the logistic partner was not able to deliver, because you were not home, you were not able to collect from the local depot or because the details information were wrong we cannot be held responsible and we will have to send it back at your cost. And if you do not claim the Product within 6 months as of the date on the order confirmation, Bam Luxury Store shall become the owner of the unclaimed Product, and may destroy, donate or otherwise make use of the Product.

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

SECTION 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new Services and/or features through the website (including, the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and Services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
