TERMS & CONDITIONS OF SALE
BAM LUXURY STORE
1. Company Information
These Terms and Conditions of Sale (“Terms”) apply to all purchases made through the website www.bamluxurystore.com.
The website is operated by:

A company registered in Spain
Registered address: Barcelona, Spain
Hereinafter referred to as “Bam Luxury Store”, “we”, “us” or “our”.
By placing an order on this website, the customer (“you”, “the client”) fully accepts these Terms without reservation.
2. Scope of Application
These Terms govern exclusively the sale of products by Bam Luxury Store to customers purchasing items through the website.
They do not apply to consignment services, resale services, or any transaction where a customer sells an item to BAM Luxury Store. Separate terms apply to such services.
3. Nature of the Products
Bam Luxury Store sells second-hand and pre-owned luxury items, including handbags, accessories and related goods.
All items sold are:
- unique,
- available in one unit only,
- sold as described and photographed on the product page at the time of purchase.
Due to the nature of pre-owned luxury goods:
- minor signs of wear may be present,
- variations from new retail condition may exist,
- products are not comparable to brand-new items sold by the original brands.
4. Authenticity Guarantee
All products sold by Bam Luxury Store undergo a strict authentication process prior to sale.
This process includes:
- authentication by our internal luxury experts,
- issuance of a certificate of conformity,
- and, when applicable, authentication through Entrupy or another third-party authentication service selected by Bam Luxury Store.
Authentication certificates confirm our professional assessment of authenticity at the time of sale.
Bam Luxury Store is not affiliated with any of the brands sold.
5. Prices, Currency & Taxes
Prices are displayed according to the customer’s location:
- EUR for European Union, United Kingdom and international customers,
- USD for United States customers,
- AED for United Arab Emirates customers.
Prices include applicable taxes and customs duties when required.
However, transport providers may occasionally request administrative or handling fees.
Such fees must be paid by the customer and will be reimbursed by Bam Luxury Store upon presentation of valid proof of payment, except for octroi de mer or similar local taxes, which remain the customer’s responsibility.
Bam Luxury Store reserves the right to correct pricing errors prior to shipment.
6. Payment Methods
Accepted payment methods include:
- Credit and debit cards (Visa, Mastercard, American Express),
- PayPal (maximum transaction amount: €1,500),
- Apple Pay and Google Pay,
- Alma installment payments:
- 2x, 3x or 4x without fees (up to €6,000),
- 10x with fees (from €1,500 to €6,000).
Orders are processed only after full payment has been received and validated.
7. Shipping & Delivery
7.1 Carriers
Orders are shipped using trusted carriers, including but not limited to:
- DHL Express,
- Chronopost,
- SEUR,
- Mondial Relay / InPost
The carrier is selected based on destination, value of the item, and delivery conditions.
7.2 Delivery Timeframes
Delivery times are estimates only and are not guaranteed:
- European Union:
- DHL Express: 24–48 hours after dispatch,
- Mondial Relay: 5–8 business days.
- International (US, UAE, other countries):
- DHL Express: 2–4 business days, subject to customs clearance.
Bam Luxury Store cannot be held responsible for delays caused by carriers, customs authorities or force majeure events.
7.3 Insurance & Signature
All shipments are:
- fully insured up to the declared value of the item,
- delivered against signature.
Responsibility for the product transfers to the customer upon confirmation of delivery by the carrier.
8. Delivery Issues & Claims
8.1 Lost, Stolen or Undelivered Parcels
In the event of a parcel being lost, stolen, or marked as delivered but not received, the customer must:
- notify Bam Luxury Store immediately,
- cooperate fully with the carrier and insurance investigation,
- provide any required documentation, including a police report when requested.
Refunds or compensation will be issued only after completion of the carrier and insurance investigation.
8.2 Damaged or Empty Parcels
Any issue related to damaged packaging, missing contents or empty parcels must be reported within 2 hours of delivery, with photographic evidence.
Claims submitted after this timeframe will not be accepted.
9. Right of Withdrawal & Returns
9.1 European Union Customers
In accordance with European consumer law, customers residing in the European Union may exercise a right of withdrawal within 14 days, subject to the following strict conditions:
- prior written request by email,
- return at the customer’s expense,
- mandatory insured and tracked shipping,
- item must be returned in strictly identical condition,
- all original packaging, accessories, certificates and tags must be included,
- any sign of use, alteration or damage voids the right of withdrawal.
Payment processing fees and shipping costs are non-refundable.
9.2 Non-European Union Customers
For customers outside the European Union (including the United States and United Arab Emirates):
- returns are not accepted,
- except in the case of a proven error in the item delivered.
10. Chargebacks & Payment Disputes
In the event of a chargeback or payment dispute:
- the order and any related claim will be immediately suspended,
- Bam Luxury Store reserves the right to provide all relevant evidence, including proof of delivery, signature confirmation, photographs and authentication certificates,
- refunds will not be processed until the dispute has been fully resolved.
Fraudulent or abusive chargebacks may result in permanent refusal of future orders.
11. Limitation of Liability
Bam Luxury Store shall not be liable for:
- indirect or consequential damages,
- loss of opportunity or profit,
- delays caused by carriers or customs authorities,
- misuse of the product by the customer.
When liability applies, it is strictly limited to the amount paid for the product.
12. Governing Law & Jurisdiction
These Terms are governed by Spanish law.
Any dispute arising from these Terms shall fall under the exclusive jurisdiction of the competent courts of Barcelona, Spain.
13. Modifications
Bam Luxury Store reserves the right to modify these Terms at any time.
The applicable version is the one in force on the date the order is placed.
CONSIGNMENT TERMS & CONDITIONS
BAM LUXURY STORE – CLIENT CONSIGNORS
1. Company Information
These Consignment Terms & Conditions (“Consignment Terms”) govern the consignment relationship between Bam Luxury Store and clients depositing luxury items for sale (“the Consignor”).

Hereinafter referred to as “Bam Luxury Store”, “we”, “us” or “our”.
By submitting an item for consignment, the Consignor fully accepts these Consignment Terms.
2. Nature of the Consignment Relationship
The consignment relationship does not constitute:
- a sale of the item to Bam Luxury Store,
- a partnership,
- an employment or agency relationship.
The Consignor remains the legal owner of the item until it is sold to a final customer.
Bam Luxury Store acts solely as an intermediary responsible for authentication, presentation, marketing and sale of the item under the agreed conditions.
3. Submission & Shipping of Items
Items may be:
- shipped by the Consignor using a prepaid insured shipping label provided by Bam Luxury Store, or
- exceptionally delivered in person (rare cases).
All shipments arranged by Bam Luxury Store are insured up to the declared value stated in the consignment agreement.
Risk during transit to Bam Luxury Store is covered by our shipping insurance, subject to carrier conditions.
4. Authentication & Acceptance
All consigned items undergo a strict authentication process, which may include:
- internal expert review,
- third-party authentication services (including Entrupy or equivalent).
4.1 Non-Authentic or Doubtful Items
If an item is determined to be:
- counterfeit,
- doubtful,
- misrepresented,
the Consignor will be informed and provided with authentication evidence.
In such cases:
- authentication fees,
- return shipping costs,
- and any related handling fees
are borne by the Consignor.
For high-value items (including Hermès), additional authentication fees may apply.
4.2 Stolen or Illicit Items
If an item is reasonably suspected to be stolen or linked to unlawful activity, Bam Luxury Store reserves the right to:
- refuse the item,
- suspend the consignment,
- notify the relevant authorities if legally required.
No compensation will be due to the Consignor in such cases.
5. Pricing & Price Adjustments
The sale price is agreed upon with the Consignor and documented in the consignment agreement.
Price reductions:
- may only be applied with the explicit consent of the Consignor, or
- may be applied at Bam Luxury Store’s expense without affecting the Consignor’s payout.
Promotions or marketing campaigns may be applied under the same conditions.
6. Storage, Insurance & Care
While stored at Bam Luxury Store premises:
- items are insured,
- handled with professional care,
- stored in secure conditions.
Bam Luxury Store’s liability is limited to the insured value stated in the consignment agreement.
7. Sale & Payment to the Consignor
Payment to the Consignor is made by bank transfer only, according to the following timelines:
- Standard sales: payment is issued one week after the Thursday following the sale, provided no dispute exists, if no cancelation from the end customer.
- TikTok Shop sales: payment is issued 15 days after confirmed receipt by the end customer.
- Hermès items: payment is issued 15 days after confirmed receipt by the end customer.
- Cash purchases by Bam Luxury Store: payment is issued on the Thursday following the purchase.
Bam Luxury Store reserves the right to delay payment in case of:
- customer dispute,
- chargeback,
- suspected fraud,
- ongoing investigation.
8. Unsold Items & Withdrawal
If an item is not sold, the Consignor may request its return after a minimum period of two (2) months from the date the item is listed online.
Return shipping costs and insurance are entirely borne by the Consignor.
Bam Luxury Store shall not be responsible for loss or damage occurring during return shipment arranged by the Consignor.
9. Non-Responsive Consignor
If the Consignor becomes unresponsive for an extended period despite repeated contact attempts, Bam Luxury Store reserves the right to:
- suspend the listing,
- continue storage at the Consignor’s risk,
- apply reasonable storage or administrative measures where legally permitted.
10. Finality of Sale & Disputes
Once an item is sold:
- the sale is final,
- the Consignor may not reclaim the item,
- the agreed price may not be contested.
Any attempt to dispute a completed sale constitutes a breach of these Consignment Terms.
11. Liability Limitation
Bam Luxury Store shall not be liable for:
- indirect or consequential losses,
- market value fluctuations,
- delays in sale,
- actions taken in good faith under these Consignment Terms.
Our liability is strictly limited to the insured value of the item as stated in the consignment agreement.
12. Governing Law & Jurisdiction
These Consignment Terms are governed by Spanish law.
Any dispute arising from or relating to these Terms shall fall under the exclusive jurisdiction of the courts of Barcelona, Spain.
13. Modifications
Bam Luxury Store reserves the right to amend these Consignment Terms at any time.
The version in force at the time of item submission shall apply.
HERMÈS SPECIFIC PROVISIONS
Article X – Special Provisions Applicable to Hermès Items
Due to the high value, increased legal exposure, and significant counterfeit risk associated with Hermès items, enhanced and specific rules apply to any Hermès item consigned to Bam Luxury Store.
X.1 Mandatory Enhanced Authentication
Any Hermès item consigned to Bam Luxury Store shall be subject to:
- an internal expert authentication process, and
- and/or an advanced authentication performed by a specialized third-party provider, such as Entrupy or any other expert selected at Bam Luxury Store’s sole discretion.
Bam Luxury Store retains exclusive authority to determine the authentication method deemed appropriate.
X.2 Hermès-Specific Fees
In the event of:
- serious doubt regarding authenticity,
- inconsistencies in documentation or physical condition,
- failed authentication,
- or confirmed counterfeit,
a fixed handling, authentication, and administrative fee, starting from a minimum of EUR 200 (incl. VAT) per Hermès item, shall be automatically charged to the Consignor.
These fees cover, without limitation:
- advanced authentication procedures,
- administrative processing,
- risk management,
- and legal exposure.
Such fees are non-refundable, regardless of whether the item is accepted for sale.
X.3 Absolute Right to Refuse Sale
Bam Luxury Store reserves the absolute and discretionary right to:
- refuse the listing of a Hermès item,
- suspend or remove it from sale,
- withdraw it from any sales channel (website, live shopping, third-party platforms),
without any obligation to provide further justification beyond considerations of authenticity, legal risk, compliance, or brand positioning.
X.4 Enhanced Declarations by the Consignor
The Consignor expressly represents and warrants that:
- the Hermès item is genuine and authentic,
- it has been lawfully acquired,
- it does not originate from theft, fraud, or unlawful possession,
- it is free from any lien, seizure, claim, or third-party right.
Any false declaration shall engage the sole civil and criminal liability of the Consignor.
X.5 Suspicious, Stolen, or Litigious Hermès Items
In the event of suspicion of:
- theft,
- fraud,
- handling of stolen goods,
- or any criminal offence,
Bam Luxury Store reserves the right to:
- immediately suspend the contractual relationship,
- retain possession of the item for verification purposes,
- fully cooperate with competent authorities,
- transmit any required information or documentation,
without the Consignor being entitled to any compensation or indemnity.
X.6 Hermès-Specific Deferred Payment
For any Hermès item sold:
- payment to the Consignor shall occur no earlier than fifteen (15) days after confirmed delivery of the item to the final buyer,
- and only after the expiration of all applicable dispute, chargeback, platform review, or investigation periods.
No payment shall be made while any doubt exists regarding:
- the validity of the transaction,
- authenticity,
- compliance,
- or buyer claims.
X.7 Express Acceptance
By consigning a Hermès item, the Consignor expressly acknowledges and accepts these Hermès-specific provisions, which are stricter and prevail over the general consignment terms applicable to other brands.
